Terms of Service

Equiplyx is an online marketplace where sellers list new, used, and refurbished commercial restaurant equipment, and buyers purchase it. Equiplyx is not the seller of the equipment listed. We provide the platform, payment processing, and buyer protection; the contract of sale is between buyer and seller.

You must be at least 18 and able to enter into contracts. You are responsible for the accuracy of your account information and for activity under your account. Do not share your login. Tell us promptly if you suspect unauthorised access.

Sellers are responsible for the accuracy of every listing. When you list equipment you confirm:

• You own the item or are authorised to sell it.
• Photos show the actual item, and the described condition is honest.
• Specifications, hours of use, and known faults are stated truthfully.
• The item is legal to sell and complies with applicable safety requirements.

Misrepresented items may be removed and the sale refunded. Repeated misrepresentation can result in account termination.

Clicking Buy It Now, having an offer accepted, or winning an auction creates a binding commitment to purchase at that price. Bids cannot be retracted once placed. Auctions ending within the final two minutes are extended so late bids can be answered.

Sellers may cancel an unpaid order and relist the item if a buyer does not complete payment promptly.

All payments must be made through Equiplyx. Payment is held until the equipment is delivered as described, then released to the seller. Equiplyx charges sellers a commission on completed sales; the current rate is shown before you list.

Card processing and seller payouts are handled by Stripe, and your use of them is subject to Stripe's terms. Equiplyx does not store full card numbers.

Arranging payment outside Equiplyx is prohibited. It removes buyer protection, leaves both sides without recourse, and deprives us of the fees that keep the marketplace running.

Accordingly, exchanging phone numbers, email addresses, or outside payment details through our messaging is not permitted, and messages attempting it may be blocked or flagged. Arranging pickup or freight is allowed — it is payment that must stay on Equiplyx. Circumvention may result in suspension.

Sellers state the shipping method on each listing. Risk of loss passes to the buyer on delivery, or on collection where the buyer arranges pickup. Buyers should inspect equipment on arrival and report problems promptly so protection can apply.

• Fraudulent listings, stolen goods, or items you cannot deliver.
• Manipulating bids, including bidding on your own listings.
• Harassment, abuse, or misuse of another user's details.
• Scraping, or interfering with the operation or security of the service.

Used commercial equipment is sold as-is unless a seller states otherwise. Equiplyx does not inspect, test, certify, or install equipment, and makes no warranty about fitness for a particular purpose. Buyers are responsible for confirming that equipment suits their premises, utilities, and local code, and for professional installation where required.

To the fullest extent permitted by law, Equiplyx's liability arising from a transaction is limited to the amount of that transaction.

We may suspend or close accounts that breach these terms. You may close your account at any time; obligations from completed or pending transactions survive closure.

We may update these terms. Material changes will be posted here with a new effective date, and continued use after that date means you accept them.
